"IR35 Defence Strategies" David Smith 4th Edition is great ...

"IR35 Defence Strategies" David Smith 4th Edition is great ...  ISBN 978 1 84766 291 0, particularly pages 165/6 on Personal Liability, sections 13.13 thru 13.18, which exposes the scandal that OAPs - if caught by IR35 - are theoretically liable to pay employeERS' NICs if there are insufficient funds in the HMRC alleged "intermediary company", but that this aspect may not be enforced in all cases!

QUESTION: Why doesn't HMT insist that this employeERS' NICs OAPs' liability aspect of new Labour's nasty IR35 "tax terror" is waived by a new ESC, etc, so that the intellectual capital of UK's OAPs may be unlocked, leading to [immigration free] UK economic growth, as consistently requested by new Labour's "Balls" etc?

PUBLIC SECTOR COSTS SAVINGS NOTE: If OAPs are mentally challenged by work, then they'd be less liable to pre-mature dementia, etc, thus saving costs for NHS! Simples ...

Would you mind not posting "Flagging?"

@ MartinB This sort of comment doesn't add to the discussion.

What does flagging mean?
Just curious. I am very interested in IR 35 as I have identified great opportunities here where I am based.
Unfortunately I have had a contract reviewed and working practices by 2 experts (well known names- not sure if I'm allowed to mention). One has passed and one a total fail. One is willing to insure. One ran a mile.what to do?! Perhaps a separate post, I'll post it later today, out and about just now.
