Some heavies turned up at our offices today. We rent them. Apparently our landlord owes money and they claim that under a law they can take our possessions as we rent a place from him. In the end we called the police. We can prove everything is ours. Does anyone know if this is true? The police have said to call them if he shows again but I would rather know the legal position.

I am no lawyer but I would have thought that logic dictates that the only goods that can be distrained are those belonging to the debtor.  As a matter of interest did you ask to see a copy of the distraint order - even if you were the debtor that would be the essential first step.

He flashed a piece of paper saying that that was it. I was in a state of shock to be honest. When someone walks in and looks round then says they are going to parcel up all your assets its a shock. I have since found out that they can take them but you have 5 days to prove they are yours. After that time they are sued for damages which start at £20,000 so in reality it would be a big risk for them. I have just been told this by a solicitor but I am still very shaken up.

You won't be surprised to know the solicitor is correct. It is important that if they come again you see the paper they claim gives them aright of action. I was once on an audit and bailiffs emptied the room I was in expect my desk only to have bring everything back as they had come to the wrong office
