I have 4 people who own one property - Husband and wife and the husband's parents. The problem is that its only the husband's sole name on the deeds. All four own it equally 25% each. Would they need to get a deed in trust maybe or can it be assumed they own it equally, they genuinely own it equally.

Also another question, as the wifes earn very little and husbands are higher rate payers can the husbands make a no gain no loss transfer of some of their share? So say the wifes own 40% each then husbands 10% each or do HMRC take dim view of this?

On what basis have you reached the conclusion that ownership is different from what the deeds say?

Yes spouses can make no gain no loss transfers to each other. What HMRC think about it is irrelevant.
