Naming new company

Didn't find your answer?

I have a client who wants to name her company 'XYZ Incorporated Ltd' - is that permitted?

Can't see any reason why not unless it's already taken by another company.  Why do you ask?

Well it's free at present on Co's House website.

Have you asked them?

Sensitive names

Well done, OGA.

The sensitive names can turn into farce.  We recently needed to form a residents management company.  They usually take the name of the block of flats or the road.  Our one was someting like Kingsbourne Road RMC Ltd.  Because it has "King" - which is on OGA's list - in the name, we had to obtain the consent of the Cabinet Office in advance.  I do not know if you would have to obtain consent for Barking Road RMC Ltd!

I note, though, that there are a few companies on the register with "Two Hats" in their name.

(If you don't know what I'm on about say Two Hats quickly).

There's also a company called Novak & Goode Limited.

Study the list

that OGA referred you to for "sensitive" words - then carefully study the registry of existing company names.

It amazes me that CH doesn't check new applications for compliance with the "too like" regulations.  As they don't, you could register "XYZ Incorporated Ltd" and then find, say six months later, that you are forced to change your company name because some pre-existing company has successfully claimed that "XYZ Incorporated Ltd" is "too like" their name.

We offer a service to our clients to sweep Companies House every six months, looking for more recently registered "too like" names and forcing the other party to rename.  We get close to 100% decisions in our favour, too - about a third of whom seem to dissolve as a result.
