I was just wondering if any other AccountingWeb members had any clients receiving a letter from NHS England or the local Trust requesting information be sent to "The Off Payroll Worker Team" in Leeds.

It seems every NHS worker receiving income outside of the NHS payroll system are being requested to send for copies of accounts and tax returns as evidence that the correct tax and national insurance is being paid over.

In my view they have little right to ask for such information and I will be sending just a letter stating that the correct Tax and NI is being paid over.

I think they are aiming for personal service companies, but have targeted every off-payroll provider. It's all very odd?

I would be interested to hear other members thoughts.

IR35

Had a similar thing for another client with NHS England panicking if companies that are providing services as a contractor would be caught by IR35.

I'm wondering why NHS England are worrying as it would be the contractors limited company that would foot the tax and national insurance bill.

Treasury guidance

I think that Treasury guidance in August 2012 requires the Trust to ensure that IR35 is being correctly applied. This followed the furore about higher paid public sector workers who were not being paid through PAYE.
