Here I am sat scratting my head at the moment, wondering how to solve this problem.

I have a long term close friend for whom needs a tax return completing for 5 Apr 15. A good man and many would say a well-respected man within the community. His wife has asked if I could help.

He would have normally completed the tax return himself, however due to a drastic turn in his health, he now resides in a hospice, and unsure as to how long he has left.

He always filed a paper return, which would naturally require his signature, but he is not able to complete or sign the return.

No problems with confirming his identification, I have known him for many years, he even our or wedding, so it is not that I do not know him( and no he was not a gate crasher). However I may not be able to get authorisation to act on his behalf, as I cannot obtain his signature due to his ill health.

I thought about some bespoke software, but as it is a paper return, no on line account will be in place.

Not sure as yet if an Enduring Power of Attorney (EPA) is in place, but would HMRC accept a 64-8, signed by his wife/executor with a copy of the EPA.

Would it be left to the solicitor, when the fateful time arrives, but we are not sure of what time is left. Would exemptions from late filling penalties be wavered due to his health?

Rest assured, this is not a windup and not something I have had to deal with. Sorting out my own mum’s estate over the last two months has been hard enough.

Any help would be appretiated

File online.  HMRC are not preventing you from doing so but I would expect you would need a PoA in place so they can sign your contract and you can file as tax agent.
