Tax Returns have been sent to our client at an old previous address which were never been forwarded to him. HMRC have now updated their records and are now in hot pursuit. Am therefore submitting all in-date Returns and appeals against the late filing penalties.

As far as 2008/09 is concerned, I am hesitant to file a Return for this year as it is out of date. I have just spoken to HMRC and they have said that a Determination has not been issued for that year and that the late filing penalties have been remitted. They couldn't say whether or not my client should submit a Return for the year and I don't want to do so if it is not strictly required.

So, my question is, should my client submit a Return for 2008/09 which is out of date, hasn't had Determinations issued, and the late filing penalties have been remitted?

Paper

I have a client in a very similar position. My client has income from property which I assume generated the 2009 tax return, he had not filled in a return previously as he was a serving member of HM Forces. All penalties have been dropped but I have been told by HMRC to submit a paper return, there is no liability as a loss was made.

You have not told us why your client was required to complete returns and whether the 2009 was the first he was required to submit
