p35 late filing penalty

A client has not submitted their P35 for 2012/13 and just received a late filing penalty of £400. I thought HMRC had put measures into place to send out reminders sooner so that employers would be able to rectify the situation earlier or was this a dream?

Batch

Certainly a batch of £100 penalties were issued. Maybe your client got one?

I got 3 penalties yesterday

I received 3 penalties for clients yesterday, all incorrect.  I think we did get reminders a couple of months ago, but as they were generic and I knew we had filed for the three companies in question, I ignored them so not really a lot of use!

 

We did not get a £100 penalty.

Consolation

If its any consolation HMRC are losing cases at tribunal where the £400 was the first reminder. perhaps if you appeal on those grounds they will reduce it

HMRC wasting our time as usual

I got a penalty notice for £400 for client for 2012-13 when I deliberately waited until 6th April 2013 to set up current year payroll scheme. I've just written to say there can't be a penalty if he's done nothing wrong.

I bet there are hundreds of these notices going out incorrectly, upsetting people unnecessarily.
