Penalties for an amended p35 (2012/13)

The total deductions were about £1000 but HMRC have said the penalties will be £1200 (£100 for 12 months).

When the client said it wasn't worth it the HMRC advisor told him he was under a legal obligation to submit the P35 and warned him the phone call was being recorded!

Anyone like to comment please while I check I haven't stepped into the garden in Alice in Wonderland.

It could be, yes.

He is correct if this is the only P35, being £100 per month.

Assuming you are correct in saying this is an amendment to an already submitted return, then penalties will be for incomplete or inaccurate returns, the maximum penalty is 100% but this seems unlikely to be anywhere near the final penalty for an unprompted correction of an error.

The disclaimer here is that I do not deal with PAYE on a daily basis, so perhaps someone else could confirm.
