Hi I have a client who has submitted his 2011, 2012 and 2013 tax returns late and this has incurred the wrath of HMRC. He was badly advised by his ex professional advisors. HMRC have levied penalties of £1,600 per tax year for 2011 and 2012 and £1,300 for 2013 being £100 for late filing £300 for filing 6 months late for all three years £900 per year daily penalties of £10 per day all three years and £300 on 2011 and 2012 for filing 12 months late.

The tax bills are around £2,000 on 2012 and 2013 and nil on 2011 as covered by personal allowance.

I did get 2010 which was also late agreed at a 10% penalty of tax due. HMRC have said they may consider later years penalties under Section 7 Taxes Management Act 1970.

Anyone any constructive suggestions how to proceed and help reduce these penalties?

Badly advised?

How was the client badly advised?  The filing deadlines remain irrespective.

 

One consideration did the client meet the criteria for self-assessment in all years?

 

Were HM Revenue and Customs partly to blame for the late filings?
