PILONS and tax

Didn't find your answer?

Can a PILON payment be deemed partly taxable and partly not? I have a client who has a provision in the employment contract for PILON for a contractual notice period of 1 month. However, the employee is entitled under statute to 9 weeks of notice period. So, does that mean we treat one month PILON as taxable (derived from the employment contract) and the balance as tax free as it is non-contractual (just like statutory redundancy pay)? Anyone done this before?
