Question on HMRC past taxes (+penalties) on non-resident

Question on HMRC past taxes (+penalties) on non...

Didn't find your answer?

Hi, could anyone help? I left the U.K. in 2006, my company hired Deloitte to file my 2006/2007 tax return. After that it was up to me and I missed all letters from HMRC as they were sent to a previous address. The letters have recently come to my attention and I have a bill to pay for thousands of pounds even though I had no income in the U.K. during all of this time, besides no assets there. I understand I can appeal to HMRC and get the charges removed, but I totally confused about how to go about this. A year ago I got a Gateway number for self-assessment but have since discovered that it's only for U.K. residents. I wrote to HMRC and got a most confusing response telling me that I didn't have a NINO. Even though I have no immediate plans to come back, I would like to get the situation cleared up. I am also considering receiving an early payment from an offshore saivng plan generated outside of the EU and wondered if I would be liable to U.K. tax on this -- from everything I am read I wouldn't be taxed, but not 100% sure either. I would really, really appreciate responses from people who instantly know the answers to these questions and can instantly share a few words of their wisdom without taking up too much time. Regards, Mark.

Did Deloitte
Not give you a clue what might happen for future years - or advise HMRC about your circumstances?

Technical question but are you UK taX resident? How often are you in the UK and for how long?

Did Deloitte ...

... file a form P85 (Leaving the UK) for you as well as your 2006/07 tax return?  If so, you have notified HMRC that you were leaving the UK and unless the P85 stated that you had assets remaining in the UK (for example, a property for letting out), you have told them that you would not be subject to any UK tax in future.

Even if no P85 was filed, write to HMRC now saying that you have not been resident in the UK for tax purposes since leaving in 2006, that your 2006/07 tax return covering the year of your departure was duly filed and would they kindly cancel the late filing penalties, along with any tax determinations raised, and take you out of self-assessment.
