Regiatration of a Trust

Regiatration of a Trust

Didn't find your answer?

I am based in Ireland, so I am unsure of the UK legal position.

I have a client who has been appointed executor of a will made in Ireland.

A long leasehold property was transferred to a trust c.5 years prior to death. The trust allowed for the property to be sold to provide funds if required but with the provision that the property would revert to the estate in the event of death if not sold.

My client's Irish solicitor has been told that the original trust was varied by verbal instruction to the trustees, but this has not been documented.

We are wondering if a register of trusts is maintained in the UK and if so, where can it be accessed?

There is no dispute of the eventual beneficiary of the property, the only problem arises in ensuring the Irish Probate documentation is completed correctly.

Any assistance would be appreciated.
