Just had a phone call off a potential client who had set up a PAYE scheme and ended up on the pilot scheme and has been unable to file a P35 (obviously because there isnt one due)  They have filed the 2 RTi submissions for this year so they cant even be taken out of the pilot scheme to enable them to file a P35 for last year.

I know HMRC (and other software vendors) were working on a solution to this but is there an update anywhere on this?  Just checked the HMRC gateway and there still doesnt seem to be an option to file anything for anyone on the RTI pilot for last year?

I have the same problem, was told it would be update today, 30th May. Been told this has not been affected to my particular client so currently on the phone to them - again!

I had this problem for a client
My software provider couldn't deal with it so I ended up downloading the HMRC 2012-13 Basic PAYE Tools RTI version and retrospectively filing the RTI submissions for 2012-13. A right palaver but it worked.

Not a problem

Call the Employers Helpline on 0300 200 3200 and ask them to reset the RTI start date to 6 April.  They say it may take 48 hours for the change to be processed, but in practice, it seems to be done overnight so you should be able to file the 2012/13 P35 & P14s on the day after your call.

Eaun is correct - as long as you've not filed an RTI submission for 12/13 you can leave the pilot. It doesn't matter that you've filed this year. You may prefer to use the EYU if it's easier for you but doing a normal P35 is still an option if they didn't send any RTI submissions last year.

@onciholson.. I have called HMRC now on over 7 occasions re this and have been told every time that as I have filed an alignment for 2013/2014 I can no longer leave the pilot. Even yesterday, having spoke to three different people I was advised that I had to download Basic tools and do it that way.  I had previously been told that I could do an EYU, but yesterday told I couldn't and that the adviser I spoke to previously had wrongly advised me.  Seems it would be good if HMRC would train their staff properly and inform them all!  I have had to download HMRC basic tools, load all the data, and now waiting on the code being issued to the client.

Not my experience

I can only tell you that I have filed two 2012/13 P35s after filing the Month 1 FPS for 2013/14.  This is using Moneysoft where you do not have to file a separate EAS - the first FPS also serves for employee alignment - so it might possibly be different for Sage where you have to file a separate EAS first.

The April FPSs were filed on 26 April for payment on 30 April and I only discovered that I could not file the 2012/13 P35s 3 weeks later on Friday, 17 May.  After a call to the Employers Helpline on Monday, 20 May, they reset the RTI start date to 6 April (AKA leaving the RTI pilot) and I was able to file the P35s on 21 May.
