The following comes into force from 6th April https://www.gov.uk/government/publications/employment-intermediaries-reporting-requirements/what-this-means-for-an-intermediary with the first quarterly report due in August.

At least one client providing professional services via a one person limited company to an intermediary and then onto the end customer has received the request for the personal details from the agency. No doubt more will follow.

This client does not have a contract that is considered to be within IR35.

This particular client prepares his own personal tax return.

Does anyone know how the information will be used by HMRC?

Also the guidance says:

You don’t have to include any payment details where the payments have already been included as part of a PAYE Real Time Information (RTI) submission by any other organisation. Does this mean that 100% has been included as part of a PAYE RTI submission, or part of it (I suspect the former)?

What happens if we have a subcontract worker doing accountancy work (self employed or via a limited company) - will we need to submit a quarterly report?

If a PSC supplies more than 1 worker, including any subcontracted workers, it will be acting as an intermediary and will have to send reports for each reporting period. Will this catch a variety of client companies that provide consultancy services?

Is it necessary to advise the client that the Service Company question on page TR5 (it was in 2014 anyway) is completed? There isn't actually a specific definition by HMRC of what a PSC is, is there?

Any other advice to be given to this and similar clients?

On the Service Company question on TR5, I'm interested to hear what circumstances accountants DO NOT consider it necessary to complete, where the client operates via a one employee (the director) limited company?
