Legal question

This is more of a legal question than an accountancy one. She has claimed a benefit to which she was not entitled. The crux of the matter is whether she did so genuinely in error (which is likely to be difficult to prove) and whether that has any effect on penalties. Is there any record of the advice from the Job Centre assessor? (which is what appears to have led to her error).

As we are talking about a person that presumably doesn't have much money, Citizen's Advice Bureau is likely to be the best port of call.

If you genuinely believe that she did this in error, you might want to amend your heading. Fraud requires mens rea (knowledge that you are doing wrong). If she genuinely didn't know she was doing wrong, it is an invalid claim but not fraud.
