I have client who has come over from the US on an assignment.  He had set up the UK operation on behalf of the US company and was installed as a director

He was supposed to be in he UK for less than two years but will stay for three years max.  He hopes to leave by 31st December 2014.

His contract is with the US company and was paid a salary by the UK company

He pays his own Rent for  UK accommodation (+ other home use expenses) and wants to claim a backdated tax deduction on past tax returns

However the fact he has stayed more than 24 month in the UK and was a director indicates UK cannot be considered as a temporary assignment plus maybe being paid a salary by the UK company may indicate he was employed by the UK company ?

I know this is a long shot but is there anyway he can claim for Rent.
