Can a declaration of benefit be made in a case were one spouse owns a property but the rental income is paid (directly) entirely to the other spouse? And can this further be back dated if the situation has been like this for some time but they were unaware of the need to draw up a declaration of benefits for tax purposes?

Fact

Surely it's a question of fact.

Unless a form 17 has been submitted (is this what you mean by declaration of benefits?), the income can't be allocated to the spouse.
