I have two clients. One pays his VAT by direct debit on 12th of the month and does not get a surcharge. One pays two days previously over the phone to HMRC and is told he is just in time and then gets a £2800 penalty. Strictly speaking you have to pay by the 7th if not by direct debit. Has anyone found a way around this? My client could have paid on the previous Friday but HMRC did not pick up the phone. We have appealed and are going to a VAT Tribunal but could do with some ammunition!

Obviously my client can ill afford this and will probably have to sack someone to recoup this if we fail. He would pay on time if he could it was just cash flow!

Just to keep you informed. Luckily the VAT people had a rethink and cancelled both penalties.

 

We had a good case (in the end) but also they are supposed to offer you a review which is a statutory right and they hadnt.
