We have a client who has purchased duty paid wine in Greece and brought it into the UK with the intention to sell it. 

Unfortunately he did not know that there would be a problem with duty so has not completed the required forms (HM4 I believe) or paid any duty in the UK.

I have been given a number to ring at HMRC but after 30+ attempts there is still no answer. Does anyone have an idea of what they will say to me when i eventually get to speak to them?

Duty

They will probably want a payment of Excise Duty and most likely a penalty. I hope he hasn't sold It!!

I had a horrible feeling you would say that. 

 

He has sold some but not all of it. 

 

Still trying, and still haven't got through to, the number they gave me.

He would need a licence ( may be as TRC - temporary registered consignee) to sell wine in the UK. I have been through getting a license  through  for my client and and it requires a submission of a business plan as well. ( yes a Business plan)!
