Should I file P35 without client approval

Have a small company sole director client.

The director draws a very low salary to utilise personal allowances.

I prepare the monthly payroll, overkill I know but for completeness do it religiously every months and even furnish with a payslip.

Prepared the P35 and emailed PDF of the completed form, asking client to print, sign and return to me for online submission.

Did not hear from client, so sent a letter with P35 enclosure, same instructions but still not had approval.

Would it be a grave misdemeanour if I just proceed and filed the P35 online without client signature or email approving the form?

My instincts are that if the client can not bothered to respond then I should not file, but I know it will be an issue needing more of my time to sort, when HMRC start chasing for the form.

Appreciated any advise from my more experienced colleagues in this matter.

phone him!
Telephone him.
Make sure you have warned him that there will be penalties.
But get his confirmation that he approves the P35 - remember it is not just the figures that have passed through your payroll system that the P35 requires, but also the answers to a number of questions.

I had one like this.
I left messages daily on his ansaphone and also e-mailed him daily flagging the e-mail as "high importance". Tedious, but doesn't take too long.

I started each message with "you are about to be fined £100."

It worked. I got the P35 back this morning. I wouldn't have filed if I had not heard from him.

I wouldn't mind so much except it was the same at the end of Jan with his tax return. I
