Surrendering to IR35

Surrendering to IR35

Didn't find your answer?

I've just been asked to take on a new client, a computer consultant who's been offered a new very well-paid contract to be paid only as a Ltd Co which he needs to set up now. He seems to me very clearly to fall under IR35 (which I've avoided to date). The rules seem quite straightforward. Are there any tips/pitfalls that I should be aware of?

Check again

Respectfully, I would say check again. IME, as a accountant acting for 200+ IT contractors, very few contracts are cut and dry viz IR35 either way.

Remember its not just the written contract, but what happens in practice contributes to the "hypothetical" contract.

If there is any element of doubt about IR35 applying then I think you should give the client the benefit of the doubt, arrange a formal contract review (including the practical asepects of implementing the contract) and then, if you don't have a practice Professional Fees Insurance, get your client signed up to soemthing like Qdos freelancer club or Qdos TLC35.
