Just received a letter from a client with a change of name deed which says, for example, I now wish to be known as Ms Jane Smith rather than  Mr John Smith.

Neither the letter or copy deed makes reference to the Gender Recognition Act 2004.

So should his tax return describe him as male or female?

I have absolutely no idea, but I would have thought you wouldn't want to be called a Mr if you were a Mrs.  Good luck in asking your client which box to tick.  Professionally it's probably best to put a note in the additional information box (if you have one), as I think it would have an impact on pension entitlements etc.  Don't you love working in the modern world!

I actually came across this situation way back around 1970.  I dealt with that by having a chat with a "tame" inspector in the local office who owed me a favour.  

Obviously things have changed since then but I wouldn't just amend the tax return as I dread to think what would happen.  W"e still get letters addressed to "Mrs * ***(deceased)"  5 years after the client died so if they can't sort that one out I dread to think what they are going to make of a sex change. 

I suggest a copy of the change of name deed with a covering letter quoting UTR, NI number, date of birth etc. Perhaps a call first to establish which department deals with this.
