There seems to be two branches of the new-style 1st-tier tribunals. One deals with taxes, the other deals with benefits. With the "tax branch" a taxpayer can appeal direct to the tribunal, but it seems to me (and I should love to be corrected) that a claimant cannot appeal direct to the tribunal of the "benefits branch", but that such appeals must be referred to them by the relevant government department against whom the appeal is lodged.

So, when the tax credit office takes months and months and months to progress your appeal, stonewalling in response to every attempt to move matters forward, and simply not engaging with you, it really would have been nice if an independent judicial body could force the tax credit office to put up or shut up at an appeal hearing. That protection for the taxpayer seems to be sadly lacking. Or am I mistaken?
