TUPE or Not TUPE that is the question
A friend has just been told by his employer that the company has closed and the new company will not be honouring either this week's wages or the unpaid overtime for the last 3 weeks. Nor will any accrued holidays be given.
It appears the new business is owned by the father of the current directors.
Question is as there has been no break in trade is this a TOGC and covered by TUPE, or are the employees just "stuffed"?
