UK company while resident in another EU country

Didn't find your answer?

Hi,

I wonder if someone might know the legal issues here.

I'm considering registering a ltd company in the UK. However I'm currently resident in another EU country, but a British national. Is this legally possible?

What are the implications of administrating the company from another country?

How about payment issues? I assume dividends would not be a problem, but what about paying yourself a salary?

If anyone has had a similar experience any info would be greatly appreciated.

Thanks,

S
Sosh

be wary of profit exctraction!
Watch out with the profit extraction. I live in France and trade via a UK Ltd co and got stung the first year with dividends because in France there is a 13% (i think) social charge on investment income!

The basics
You do not have to be a British national to form a company in the UK. Both the shareholders and directors can be non-UK resident. The only requirement is that the registered office is located in the UK and that will then determine the tax district that deals with the company's UK corporation tax. UK companies are automatically treated as resident in the UK for tax purposes.

If the company pays a non-resident for work done outside the UK, it is not subject to UK income tax and hence, to the PAYE regulations.
