I have clients in the construction industry who normally employ their labour as employees...however, there are so many firms offering positions for CIS25 subbies at far better rates of pay that my client can't find staff that will be PAYE. He has to pay them at around 75-80% of the subbie rate because of NI and holidays. Is it a case of if you can't beat em, join em?

If my clients took them on as cis - what are the chances of the Revenue actually doing something about it?

Is this actually a problem?
What's the objection to the CIS25 route? From what you say I would have thought your clients could benefit overall from this approach. Your clients will be able to show they are taking on subbies because they can't find paye staff so there shouldn't be a Revenue issue.
