I have a retired couple, ex-farming stock, who still own 3 or so acres of land that is agricultural land. Too old to go back into farming seriously, but could cope with growing something like Christmas Trees on land, with relatively small maintenance that might be involved. The underlying land is agricultural value at present, but one day might get planning pemission, which clearly would massively increase it's value. I am looking for suggestions as to how to get the land to qualify as a business asset for BATR and/or BPR for IHT purposes? Any suggestions or is this just asking for too much for Christmas??

Case law

There was a case on this, Ellis v Shide Trees - only remember it as Ellis was the last proper District Inspector we had locally, and the role model for Hector The Inspector (remember him?). Mr Ellis used to actually wear a bowler hat on his way into the tax office.

Thanks for the link Paul. Very interesting. Whilst I have still to investigate the potential links to the actual SPC decision and the HMRC internal manual, can I ask you.
Is your interpretation that planting of Christmas trees would potentially qualify the land as a business asset? (for BATR and/or BPR)?
