19th May: End-of-year PAYE filing deadline

HM Revenue & Customs (HMRC) is urging employers to file their PAYE end-of-year returns by the 19th May deadline, or they could face a penalty.

Employers with fewer than 50 employees will get a £100 tax-free incentive payment if they file online.

HMRC points out that if you want to file online for the first time then you must first register with HMRC's online PAYE service. It can take a week to get the activation PIN after you've registered, so it's important to register as soon as possible. Alternatively, you can ask an agent or payroll bureau to file your return online, and the filing incentive is still payable.

Q. Is everyone entitled to a holiday on the bank holiday dates?

A. No. Bank holidays, as with other pay and conditions of service issues, are a contractual matter between employer and employees. The law does not give statutory rights to time off on bank holidays or to extra pay. This has always been the case. Employees should check the position with their employer if they are in doubt.

Loss of filing incentive
If the P35 is filed online after 19th May but within the extra statutory concession extra time limit, is the filing incentive lost?

Yes, but ...
ESC B46 extends the deadline to the last working day within 7 days of the official deadline, so that is Friday, 23rd May, because 26th May is a bank holiday.

Incidentally, neither of your links work because you have included a comma at the end of the first and a full stop at the end of the second.
