The House of Lords have at last announced that they will hear HMRC's appeal in the case of Jones v Garnett on 5th June 2007. They have scheduled the hearing to take three days, and it will be several weeks thereafter before a judgment is published.

The case concerns the application of the settlements provisions in s.660A ICTA 1988 to a husband and wife run business. The saga has dragged on in the courts for the last four years, creating fundamental uncertainties for many in couples in business. It is not known how many couples who have set up companies together have now disbanded as a consequence. This still remains an option for those who fear that the Lords will come down on the side of the Revenue. Disincorporation does not preclude a discovery assessment after the event.
