JDI Trading wins HMRC VAT repayment appeal

A mobile phone company has won a legal appeal against HMRC for a repayment of almost £700,000 in VAT incurred on the sale of mobile phones connected to missing trader fraud.

The first-tier tribunal, JDI Trading Limited vs Revenue and Customs, TC02309, concluded that HMRC had established that JDI have realised it was likely that the nine transactions with an Italian company were connected to the fraud. 

Although, they ruled, this was not enough for JDI to be regarded as a participant and denied its input tax.
