Anything to prevent claiming 2 WFH allowances

H&W each claiming

Didn't find your answer?

Has anyone seen anything that would prevent each individual claiming the WFH allowance where both individuals work for the same employer and live in the same home - H&W for example?  Obviously costs incurred would not double.

No, nothing to prevent them both claiming the £26 per month payment IMO.

However, if they're looking to claim a higher amount based on actual costs, then I would expect the fact that they share a house to be factored into the calculations.

exactly what I thought, seems wrong logically but since when has tax been logical

Agree two allowances
allowance is per person
Actual costs irrelevant. Same allowance for 1 bed flat and 10 bed mansion.

They're using twice as much of their house for work so should claim twice as much. I'd say the same if they were basing it on actual costs and working in different rooms.

How do you know that?

(Not that I disagree that each should be entitled to the allowance)

There is not double the cost either, some of the cost will be fixed, if there were 10 people there wouldn't be 10 times as much costs would there, and if they were all working in one room.....

And before anyone asks, if H and W undertake business travel together in their own car they cannot both claim 45p/25p per mile.

They could if they used both cars.

Yes, pretty obviously (as Justin might say) but that wasn’t the scenario that I was addressing.

Martin lewis had specific confirmation from hmrc they could claim . interesting because thats prevented in the normal equivalent rules for self employed anless theres a relaxation I'm not aware of this year . the hmrc microsite also allows you to claim the full year allowance ven though required at home for one day

The trouble with arguing with HMRC that 'Martin Lewis says ...' might sound the same as 'my mate down the pub says ...'. I'd prefer to is it in writing on GOV.UK.

So does your mate down the pub have an OBE for advising consumers? Does your mate run a TV series where giving correct advise is paramount to the success of the programme and for the many people who are employed on putting that programme together, including a client of mine.

No, but your mate on TV doesn't have the force of law either. If it went before a judge what would the judge say 'if Martin Lewis says so and so that must be the law'?

I don't see a problem in two people claiming working from home
If you have a Limited company situation, would it be able to pay two lots of working from home allowance?
This wouldn't be taxable or NI able?

Its an allowance....that's why both can claim it....it doesn't reflect the actual reality (the person can effectively decide how much/little extra 'actual' cost they incur by not turning on the heating etc, they still get the same allowance).

If you have a property rental business run from home that you have claimed the WFH allowance for, and are now working from home for your main fulltime job, can you claim the allowance twice?

What do people think?

Karen

1. I agree to two PAYE WFH can claim the allowance.
2. What about two SE WFH? Say it's two totally separate jobs can they both claim simplified expenses for the household costs?
3. What about one PAYE worker and one SE worker in the same household? Can they both claim?
My head hurts! I need more wine or is it whine?

PAYE WFH is per worker so all can claim, no restriction even if working for same employer. See https://www.gov.uk/hmrc-internal-manuals/employment-income-manual/eim327... lower half has loads of examples, all talk about the worker and make. SE WFH only restriction if two or more business partners work from the same home only one deduction is made, see https://www.gov.uk/hmrc-internal-manuals/business-income-manual/bim75010.

And would you put 2 x £312 through the company's accounts and credit DLA?
