Can I pay rent to my husband

Didn't find your answer?

Husband owns retail premises that has been shared by me (sole trader) and another independent business (whom paid rent) for past 6 years. The independent business owner has now moved on. Can I therefore pay my husband rent for the sole use of the premises and account it as an allowable expense ?

Yes

But it's taxable income in his hands.

Thanks for info....husband on low income (state pension) and does complete self assessment....rent will only slightly take him over his personal allowance.

In that case, there may be more to it. Husband (and possibly you) may be entitled to other state benefits. Check the calculator at turn2us.org.uk

Presumably Husband was completing self-assessment to declare the rental income from former tenant?

Ask your accountant about this, as it effectively transfers income from you to your husband. Whether this is advantageous or not depends on your circumstances.
