CJRS and non-UK businesses

Assuming not eligible as not UK organisations?

Didn't find your answer?

My 2nd offbeat scenario concerns businesses without a UK establishment but with employees and a PAYE scheme. The eligibility criteria state "Any UK organisation with employees can apply".

Assuming businesses that are not established for other tax purposes will need to make staff redundant if necessary. Likewise they would be ineligible for the Business Interruption Loan Scheme.

Appreciate your thoughts.

You will need to wait for the guidance but it does seem to say UK organisations. Why does it not pay tax here, what are the employees doing? And how come it has a PAYE scheme, I though the employees had to operate this themselves?

Why would they be eligible for the loan if they don’t have a business here? Can’t they claim in their country of residence?

My starting view is that they would not be eligible. The case here is a UK sales person who works for an overseas business. I admininister the PAYE scheme as agent.

Even if the business has a UK permanent establishment I doubt it is a UK organisation so I agree with your staring point.

Is it not filing UK tax returns though?
