Company strike-off

Can HMRC still pursue

Didn't find your answer?

A company is about to be struck off in the next day or two by Companies House for, from what I can see, not presenting accounts. I know for a fact that this company is trading and doing quite well. The director also has another company of a similar name already set up to probably start again

Once the company is struck off can HMRC still pursue it or the director for anything?

No. Once the company is dissolved HMRC cannot chase it for debts unless it is restored to the register at significant cost. HMRC may object to the strike off. It is rare but sometimes they do.

Failure to file Accounts is a criminal offence which can lead to the Directors being fined personally and, depending on the circumstances, those Directors could be barred from being Directors of other Companies. The possibility of fraud also needs to be considered in which case the Directors may be held personally responsible for such actions.
