Director working through consultancy contract

Will this now be caught under intermediaries legislation etc.

If a director charges consultancy fees to a company he is a director/shareholder for, for work that is separate from the office holder duties, is this likely to be considered as within IR35 if the charges are made through a service company? What if the work is invoiced as a sole trader?

I appreciate that if it is invoiced as a sole trader it won't be under IR35, but wondering if the company risks having to put onto the payroll.
