Directors Indemnity insurance

does simply having a directors incemnity policy in place mean you need to disclose?

A company we act for has always paid for a directors indemnity policy, there have been no changes to the articles or formal deed in place.

 

Does this need to be included as a third party indemnity provison under S.236(1)?

Yes.

Typical wording is "The Company holds indemnity insurance for Directors' liability"
