Distance Selling / Consumer Contracts

Hi all,

I've been reviewing my admin this weekend (fun times) and am working through ICAS' GPPM. One item is around distance selling and the 14 day cooling off period for consumers.

I've never noted before that if the individual is “acting for purposes which can be regarded as inside their trade or profession”, the regulations do not apply. In this sense, could you argue that they are only seeking accounting services because they are sole traders and therefore fall within this clause? My thinking is that the regulations would therefore only really apply to individual shareholders/Directors of companies and partners in a partnership.

How do you approach the DSR/Consumer Contracts regulations?

Ideally get them to sign a contract and wait out the period of cancellation. Having said that, also try to keep them happy. If they invoke the rights something has gone wrong somewhere.
