Employer Paid Travelcard and Maternity Leave

If an employee gets a Travelcard paid annually by her employer, should she still get the Travelcard paid for when she is on Maternity Leave? It is a benefit, like a company car which someone on Maternity gets to keep, so I would have said yes but can't find any clear guidance.

The law changed in October 2008.

Employees are now entitled to all their terms and conditions of employment, excluding remuneration. This is for both ordinary and additional maternity leave.

Employees continue to accrue benefits such as annual leave, subscriptions, memberships, company car, mobile phone etc.

Based on this, the employee in question is entitled to continuity of the travel card.

"All non-pay contractual benefits must continue during statutory maternity leave. These may include any childcare vouchers, company car or mobile phone provided to the employee as part of their contract of employment."
