Forex spread betting using Ltd company funds

Can a company spread bet on the Forex and how are they taxed ?

Didn't find your answer?

The director of our client company, has placed a significant sum of surplus company money with a `financial manager`, who spread bets on the Forex market, and who has established an impress track record of returns.

I am aware that in the hands of an individual, any `profits` are tax free, as they are classed as betting winnings, but unsure as to the tax treatment or, for that matter, the legality of a company placing such `bets`. The opinion of others would be appreciated.

www.gov.uk/hmrc-internal-manuals/business-income-manual/bim56900 does this help?

Regarding the legality - the companies own documentation may prohibit this you would need to read the articles and memorandum.
