Claiming furlough for employees

Didn't find your answer?

Does anybody know if there have been any recent updates regarding the RTI submission dates for employees - I understand that currently it is still 30th October but as the country has been placed into another lockdown is it not possible to claim for new employees since that date?

I don't see what lockdown has to do with employees being on an rti submission? They would have been on it regardless of a lockdown would they not?

The 31 October date may have been set to prevent claims for temporary staff hired for the Christmas period who would otherwise have been let go in January anyway.

To save you the trouble of asking in future, you might find it useful to subscribe to updates from HMRC. And to check the lastest guidance on gov.uk

The 31 October deadline was introduced just before the November lockdown, when the CJRS was also extended.
Although we have another national lockdown, I am not aware of any changes to that cut-off date.

Thanks for that as it confirms what I thought but a client seems to think that as we have another national lockdown he should be able to claim for a new employee that missed the 30th Oct RTI submission deadline

It's always a worry when a client thinks that something "should" be allowed ... it either is or isn't. And in this case it isn't!

The relevant guidance at https://www.gov.uk/guidance/check-which-employees-you-can-put-on-furloug... has been updated 8 times since details of the CJRS extension were published on 10th Nov ... but all of these were clarifications on situations where the principal criterion had first been met.

And this principal remains "For periods from 1 November onwards, you can claim for employees who were employed on 30 October 2020, as long as you have made a PAYE Real Time Information (RTI) submission to HMRC between 20 March 2020 and 30 October 2020, notifying a payment of earnings for that employee".

So if the employee (for whatever reason) has not had earnings reported via an FPS submitted on/before 30th Oct, then the employee is not eligible for inclusion in any CJRS claim made by the employer from 1st Nov onwards.

I suspect it is just the employer being lazy by not reading the guidelines and hearing headlines from months ago and then just wanting his advisor to check and say yey or nay. Happens a lot, or perhaps thats just some of my clients. They throw the bomb in to the conversation and see what happens. But then they pay me handsomely for it so Im not complaining.
