Furloughing a Director - statutory duties

Furloughing a Director - what minimum statutory duties are permitted?

Didn't find your answer?

My understanding is that a Director can furlough so long as they are not providing services to their company and not generating revenue.

They can however perform minimum statutory duties. What could this include?

For example keeping records is a statutory duty in which case would doing the bookkeeping to prepare VAT returns and annual accounts that may be due in next 3 months be treatecd as an allowable statutory duty?

Would this be acceptable and are there any other statutory duties that might be okay?

You've answered your own question - as long as those record keeping are for HIS OWN COMPANY it's ok
Because clearly work done for one's own company doesn't generate business
As yourself "Who can I invoice for this"?
If the answer is "No-One" then you are ok

Yes filing of accounts, annual returns are in it

Not payroll, checking emails, invoicing, receipts of payment acknowledgement, which most one man company directors do and hence no one yet is saying to one man directors that you can be eligible for this scheme for definte.

Absolutely agreed.

Hmm, so HMRC don't want their taxes?

As PAYE returns are a statutory obligation and fines are applied if obligations are not met, I believe payroll is included as allowable work for Executive Directors.

The guidance issued so far says there cannot be any "revenue-generating activity" etc. It appears there is still further guidance awaited, as there are calls for better financial support.

But why do people pay their staff? Because they generate revenue for you

So why is that logic not applicable here for Directors

Maybe I am wrong - but if possible please refer me to, if there is any, the guideline where it states payroll is allowed.

The way I see it is that if a Company was set up and say did no trade at all and had no activity then you still as part of your Statutory duties have to file accounts and annual returns. Pretty much everything else is as a result of the company trading and with the intention of generating revenue
