Has anyone ever received a RTI penalty notice?

Bit concerned that I've not seen one.

Hi all,

I work as an agent and run a large number of payrolls. Has anyone actually ever received an in-year penalty notice for a late submission? (Other than end of year submission.)

I've not but was speaking to somebody a week or so ago that had just received one for £200.
Remember there need to be multiple failings to incur a penalty.

They are (allegedly) issued only quarterly, so the only ones that might have been issued this year would have been for the first quarter, during which you would have got the first month of late submission(s) FOC. Also, there is a general concession that an FPS submitted up to 3 days after the payday specified in the FPS may be late, but is not subject to a penalty.

I have a client who just sticks his head in the sand with any form of running a firm correctly including PAYE for him and his wife's earnings ( non director). I don't bother with him anymore - that's his look out. You can only do so much. However a penalty notice was recently received. They only seem to be issued in really bad negligent cases.

Further to my earlier comment, I see from the latest Employer Bulletin, No. 62, that penalty notices for the first quarter of 2016/17 were issued only from 12th September onwards. If they were sent by HMRC's customary snail mail, employers would not have received them before 23rd September.

Yes Euan is right, very odd that first quarter penalties due in early July went out over two months late and equally because the data cannot be relief upon they now all have to be risk assessed not automated so very few are being issued. In the MTD proposals the new PAYE penalty regime is outlined that will probably be from April 2018, but will need a wholesale improvement in data quality if it is going to happen. It does feel inappropriate as outlined in comments above that those who play fast and loose with the system have be really negligent before they are penalised
