High Income Child Benefit Charge

If husband and wife separate and now live in separate houses [not an actual legal divorce] 2 months into tax year and husband is the one with income >£50k does he only have to report the 2 months of child benefit received by his wife [former partner]?

Yes [EDIT: if legal separation], and if he is living with a new partner claiming child benefit, he has to pay that back too!

If not legal separation, then full 12 months.

does legal separation always mean formal divorce or are there other circumstances i wonder?

I believe it refers to separated in circumstances likely to be considered permanent. It’s possible to be separated for many years without being divorced.
