How to complete part iii Q14 /15 of US W8BENE form

I'm a UK Ltd co of 1 person, my work is executive coaching & this is for work Im doing for eBay

My question relates to part iii of the form which relates to claim of tax treaty benefits. I can see that I need to tick 14a and state that I am a resident of the United Kingdom but question 14 b leaves me stuck (The beneficial owner derives the item of income for which the treaty benefits are claimed, and, if applicable meets the requirements of the treaty provision dealing with limitation on benefits And then I have to tick one of the types of limitations on benefit - if this is the right thing to do). From looking at the internet I think I perhaps need to tick b and then "other" quoting 12(1) as the specific article. Is this right? And then do I need to complete question 15 which relates to special rates and conditions. Any help would be gratefully received. Thank you.

Your company uses a firm of accountants. Have you asked them?

No i disagree, under Part 1 you fill in 1, tick corporation in 4, tick Passive NFFE in 5, address in 6, corp tax UTR in 8b. THEN go to XXV1and tick 40a & 40b, then sign it.

14 has nothing to do with it in my opinion

i accept that these are fairly ridiculous forms and almost indecipherable

Why are you saying that they are a passive NFFE and not active? I thought passive meant that the entity's main income is interest and dividends?

In my (limited) experience, we have always signed active NFFE (non financial foreign entity) - as a manufacturer that applies to our circumstances.

Apart from that, the same as carnmores.

i might have got a bit carried away as i was completing a passive one for an investment client and possibly didn't read it carefully enough. will revisit this this morning and correct as appropriate

sorry my mistake wasn't concentrating on your form but on mine

to correct

from page 1 section 5 tick active NFFE then go straight to

XXV on page 7 and tick box 39 and sign on last page

that should be it
