ICAEW fines enforceable ? after membership lapsed

ICAEW fines enforceable even at the time was not a paid up member ?

A colleague was not a paid-up member at the time but was previously a member, a fine was imposed just before he was due resign to be a member

 Now he is not a paid-up member and was not paid up at the time of the tribunal is the fine enforceable?  Any help or guidance would be appreciated he is an elderly gentleman with no access to forums like this 

 

any help or articles would be appreciated

You cant just resign to get out of a fine.

he was already resigning due to retirement

What are they going to do if he doesn't pay? Throw him back into the Institute?

Presumably membership is a contractual relationship and "fines" are an agreed part of the contract.

If the numbers are that large, he'd need to speak to a solicitor as it's a legal matter.

I believe they are enforceable. I heard of a case where ICAEW sued the resigning member saying that the membership terms are a contract and the disciplinary process is part of that contract.
It went to court and ICAEW won.
As Accountant A said, it's one for the lawyers.

Read the Institutes Royal charter as it contains relevant provisions. A validly imposed fine has to be paid.
