Indian witholding tax

Is there any withholding tax when selling services into India?

My client is entering into a contract selling services into India and we need to know if there are any witholding taxes.

 

If anybody has a contact in India I could get in touch with?

What has the Indian customer said about WHT? What provision does the UK/India DTA make for tax treatment of the fees/charges?

If you Google, I’m sure you’ll find the big firms have booklets about tax. “Doing business in India …”, kind of thing.

Obviously not a substitute for direct advice but might shed light.

What type of Services and where were the service performed India or UK ?

See Article 13 of the India and UK tax treaty "Royalties and fees for technical services". If services performed in India then likely there will be WHT depending of course on the nature of the services

If there is WHT then you will need to get a PAN number and certificate of residency to reduce the WHT as per the treaty tax rates.
