Possibly a bit too technical for this forum, but perhaps of more general interest all the same (re possiblity of SC appeal in Barker):

It is not explained why PB-W was able to be sued personally (in Barker) when the EBT advice was given by his LLP (which would normally afford limited liability of course so that LLP members cannot be sued). Can anyone shed any light on that (although I note the advice appears to have been given initially at least before UK LLPs even existed, so that may explain it if he advised initially as a sole trader (per the above Gazette notice) and was not insured etc.)?
