GT's recent run of bad luck continues. The judge gives them a really good kicking here - see para 9 in particular (reminiscent of a famous line in Carry On Cleo):

This case could be useful to show someone has no beneficial interest in a property (re 3% SDLT surcharge etc.) simply by agreement of the parties (and no conflicting evidence), despite being on the mortgage (see para 145) and HMLR title.  

Also, strangely this is another case cited by me this year where the winning barrister sadly dies shortly before the judgment.
