what was it used for by the tenant & what was the status of the tenant? if it was a residential dwelling, it will not qualify.

Based on what you have said so far, then Taper relief is available as the exchange of contracts, as this is the important date, was prior to the 6th April 08. However all the facts are required. Regards Peter

Client was a self employed property developer, however the property in question was not in the business stock. It was rented out by the individual until sale Jan 2008.
